1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and Alpenglow AI concerning your access to and use of the alpenglowai.com website as well as any other media form, channel, or custom service related, linked, or otherwise connected thereto (collectively, the "Site" and "Services").

2. Our Services

Alpenglow AI provides consulting, business process automation, and custom software development services, including but not limited to the creation of custom Claude connector services. The specific scope, deliverables, and fees for consulting and development services will be outlined in separate, individual Statements of Work (SOW) or consulting agreements.

3. Custom Claude Connector Services

If you engage Alpenglow AI to build custom connectors to Anthropic's Claude API or other third-party services:

• Third-Party Terms: You agree to comply with the terms of service, acceptable use policies, and privacy policies of Anthropic and any other third-party providers whose APIs are integrated into your custom solution.
• Liability: Alpenglow AI is not responsible for any changes to third-party APIs, service outages, or actions taken by third-party providers (such as API rate limiting or account suspension) that may affect the functionality of the custom connectors.
• Compliance: You are solely responsible for ensuring that the data you process through the custom connectors complies with all applicable laws and regulations.

4. Intellectual Property Rights

Unless otherwise indicated in a specific consulting agreement, the Site and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us.

5. User Representations

By using the Site or our Services, you represent and warrant that you have the legal capacity and you agree to comply with these Terms of Service. You will not use the Site or Services for any illegal or unauthorized purpose.

6. Limitations of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site or our custom software solutions, even if we have been advised of the possibility of such damages.

7. Governing Law

These Terms shall be governed by and defined following the laws of the State of Colorado. Alpenglow AI and yourself irrevocably consent that the courts of Colorado shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
